Advocates for Transformation (AFT) has announced to its members that Dali Mpofu is out and will be replaced by Kameshni Pillay SC and Siphokazi Poswa-Lerotholi SC. An AFT sub committee unanimously endorsed the two senior advocates to fill Mpofu’s position.
“We recommend that the CVs of Pillay and SC and Poswa-Lerotholi SC should be obtained and urgently sent to the minister of justice with a request to process their appointments timeously for the April 2022 interviews,” the report stated to its members on Thursday night.
The sub-committee among other things looked at the role the AFT plays at the JSC following what happened at the interviews of the position of the Chief Justice. “There are concerns about the interview techniques and the impact this has had on the process. There is criticism that there is a discreet political motive, that there has been overreach and that judicial nominees have been subjected to unconstitutional processes,” the report of the AFT sub-committee entailed.

Advocate Dali Mpofu, who represented AFT, caused a stir when he asked Mlambo about the sexual harassment allegations which were levelled against him by a complainant who is kept anonymous. Mpofu’s line of questioning received mixed reaction from the legal fraternity. Members of the General Council of the Bar criticised Mpofu while there were 20 black lawyers who defended his line of questioning.
The JSC concluded its interviews and recommended the Supreme Court of Appeal President, Justice Maya, as the next Chief Justice, but in the end President Cyril Ramaphosa chose Justice Raymond Zondo.
